Pergamino Pesticide Trial: Officials Convicted, Farmers Absolved

A Mixed Verdict for Argentina's Agricultural Heartland

In a case that resonates across Argentina's vast soybean fields, the Oral Federal Tribunal No. 2 of Rosario delivered a complex ruling. The tribunal recognized that pesticide fumigations harm public health in Pergamino, a key agricultural district in Buenos Aires Province, but absolved seven agricultural producers and applicators. The court found no criminal intent, attributing the issue to insufficient state controls.

The judges did, however, convict two former officials from the local Rural Environment Directorate. Guillermo Naranjo and Mario Tocalini were sentenced to 2 years of conditional prison and a 4-year disqualification from public office for failing to perform their duties as public officials.

State Negligence: The court found the State failed to enforce adequate controls over fumigation practices, shifting blame away from private actors.

The judges requested an investigation into the mayor who was in office at the time of the events, suggesting political responsibility may extend higher. They also proposed creating a roundtable for dialogue to develop more effective regulations on agrochemical use.
