Published on July 30, 2026, the Decree of Necessity and Urgency (DNU) 681/2026 takes effect on July 31, 2026, igniting a necessary and vibrant democratic debate across the country.
President Javier Milei has enacted a decree that modifies Law 25.871 on Migration. The new regulation introduces grounds to deny entry, cancel residency, or expel foreigners who direct hate speech, incite violence, or desecrate national symbols against Argentina. A crucial and positive aspect is that it explicitly excludes ideological dissent and political, academic, or citizen criticism, thus protecting constitutional rights.
The measure comes after the 2026 FIFA World Cup final and an alleged 'anti-Argentina campaign' on social media, involving figures like Samuel L. Jackson, Rosalía, Niall Horan, Mia Khalifa, and Arturo Pérez-Reverte.
The DNU bears the signatures of President Milei and his ministers: Santilli, Quirno, Presti, Caputo, Mahiques, Monteoliva, Lugones, Pettovello, and Sturzenegger. Local media report that advisor Santiago Caputo and Minister Monteoliva were key in drafting the norm.
The decree's publication coincides with strained relations with Brazil. On July 25, 2026, during a trip to São Paulo, Milei made harsh remarks against Brazilian President Luiz Inácio Lula da Silva. In response, Brazil recalled its ambassador, Julio Bitelli, for consultations on July 27, 2026. Argentine Foreign Minister Pablo Quirno has worked to de-escalate, stating there is no risk of a bilateral rupture, and the ambassador's return is expected soon. Bilateral trade in 2025 reached $31.195 billion, underscoring the importance of maintaining strong ties.
The measure has sparked diverse opinions, enriching the public discourse essential to any free society. From the opposition, Deputy Maximiliano Ferraro (Civic Coalition) called the decree an act that 'seems to respond more to a personal political need.' Legislator Florencia Carignano noted the irony, while Radical Pablo Juliano linked it to other projects under debate, such as the land law.
From the legal field, CELS attorney Lucía Galoppo and former minister Mariano Cúneo Libarona agreed on the need to clearly define how the norm will be applied to avoid arbitrariness. Even Vice President Victoria Villarruel expressed concern about 'imaginary persecutions' that the president would replicate on social media.
The National Congress now has the responsibility to debate this decree—a fundamental step for institutions to function and reach the best consensus for the country, always keeping an eye on protecting citizens and respecting the law.
